The deal between you and us.
1. Who this is between
Pulse is provided by Cloverfields-Tech(“we”, “us”). By creating an account or using the app you accept these terms and our Privacy Policy. If you do not accept them, do not use Pulse.
2. Who may use Pulse
You must be at least 18 years old. You must not be barred from using the service under the laws of your country, and you must not have been removed from Pulse before. One account per person, and it is yours alone — do not share, sell or transfer it.
Keep your login details secure. You are responsible for what happens on your account until you tell us it has been compromised.
3. Zero tolerance for objectionable content and abusive behaviour
There is no tolerance on Pulse for objectionable content or abusive users. Content and accounts that break this rule are removed, and we do not require a pattern before acting on something serious.
You may not post, send or do any of the following on Pulse:
- harass, threaten, stalk, intimidate, impersonate or incite violence against anyone, including using the app to find or follow someone who does not want to be found;
- sexual content involving minors, or any sexualisation of a minor — this is reported to the authorities, without exception;
- pornography, sexually explicit material, or unsolicited sexual images, propositions or messages;
- hate speech or attacks on people because of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or age;
- graphic violence, self-harm or suicide content, or anything that glorifies or encourages them;
- selling or advertising drugs, weapons, sexual services, stolen goods or anything else unlawful;
- spam, scams, phishing, pyramid schemes, or soliciting money from other users;
- content that is not yours to post — see the Copyright notice;
- publishing anyone's private information — an address, a phone number, a workplace — without their permission;
- scraping, bots, fake accounts, automated access, reverse engineering, or attempts to defeat the location, safety or rate-limiting systems;
- anything that misrepresents who you are, including a profile photo that is not of you.
How we enforce it
Every user can report content or a person from the ⋯ menu on any profile, chat or moment, and can block anyone instantly — a block takes effect immediately and removes that person from your map and your inbox. Reports reach a human. We aim to review them within 24 hours and act on the ones that need it, which may mean removing content, restricting an account, or terminating it permanently.
You can also write to us directly at cloverfields.tech@gmail.com. We do not tell you what action we took on someone else's account, but we do act.
4. Meeting people in person
Read this part properly. Pulse introduces you to strangers. We do not run criminal background checks or identity verification on our users, and a Pulse profile is not a vouch for anyone.
You are responsible for your own safety. Meet in public, tell someone where you are going, arrange your own transport, and leave the moment something feels wrong. If you are in danger, contact your local emergency services — we cannot help you in the moment.
To the fullest extent the law allows, you accept the risk of meeting people through Pulse and interacting with them offline, and you agree that we are not responsible for the conduct of other users, online or in person.
5. Your content
You keep ownership of everything you post. You give us a limited licence to host and display it so the app can work — the full terms of that licence are in the Copyright notice.
We do not pre-screen everything posted to Pulse, but we may review, remove or restrict content that breaks these terms. Removing something is not a judgement we owe you an explanation for, though we will usually give one.
6. Your licence to use Pulse
We grant you a personal, non-transferable, non-exclusive, revocable licence to use Pulse on devices you own or control, for your own non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the app, except where that restriction cannot lawfully be imposed on you.
7. Subscriptions and payments
Pulse is free to use. Some features may be offered as a paid subscription. If you buy one:
- Apple or Google takes the payment — we never handle your card.
- Subscriptions renew automatically at the price shown, charged to your store account, until you cancel.
- Cancel at least 24 hours before the period ends, in your App Store or Play Store account settings. Cancelling stops the next renewal; the period you have paid for runs out.
- Refunds are handled by Apple and Google under their policies, not by us. Where the Consumer Protection Act, 2008 gives you rights we cannot exclude, those rights stand.
- Prices can change, but not for a period you have already paid for.
8. Ending it
You can stop using Pulse whenever you like and delete your account from Settings, or by writing to us.
We may suspend or terminate your account if you break these terms, if we are required to by law, or if keeping it open would put other users at risk. Where it is reasonable to do so we will tell you why. Serious breaches — anything involving safety, or content involving minors — get no notice.
Sections 4, 5, 9, 10 and 11 survive the end of this agreement, along with anything else that by its nature should.
9. What we do and do not promise
We work hard to keep Pulse running, but it is provided “as is”. We do not promise that it will be uninterrupted, error-free, or that anyone will be nearby when you open it. We do not promise the accuracy of anything another user tells you.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — including rights you have under the Consumer Protection Act, 2008.
10. Limitation of liability
Subject to section 9, to the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profits, loss of data, or for the acts of other users. Our total liability to you for any claim connected with Pulse is limited to the greater of the amount you paid us in the 12 months before the claim, or ZAR 1,000.
11. Law and disputes
These terms are governed by the law of South Africa, and the courts of South Africa have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country's law and may bring proceedings there.
Talk to us first at cloverfields.tech@gmail.com. Most things are resolved in an email.
12. Changes to these terms
We may update these terms. If a change materially affects your rights we will give you notice in the app or by email before it takes effect. Continuing to use Pulse after that means you accept the new version; if you do not, delete your account.
13. If you downloaded Pulse from the App Store
This agreement is between you and Cloverfields-Tech only, not with Apple. Apple is not responsible for Pulse or its content, and has no obligation to provide any maintenance or support for it. If Pulse fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Pulse. Apple is not responsible for addressing any claim by you or a third party relating to Pulse, including product liability, regulatory non-compliance, or consumer protection claims, or for investigating or defending any third-party claim that Pulse infringes intellectual property rights.
You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties. You must comply with any third-party terms that apply to your use of Pulse.
Apple and its subsidiaries are third-party beneficiaries of these terms, and on your acceptance Apple has the right (and is deemed to have accepted the right) to enforce them against you.
14. General
If part of these terms is unenforceable, the rest still applies. Not enforcing something straight away does not waive it. You may not transfer your rights under these terms; we may transfer ours if Pulse is sold, without reducing your rights.
